Resurgent Capital Services collects consumer debt for creditors and third-party debt buyers. It has offices in Greenville, South Carolina, and Cincinnati, Ohio. It is a subsidiary the Sherman Financial Group, a global financial company headquartered in New York, NY.

The U.S. Consumer Financial Protection Bureau (CFPB) says it received 718 complaints about Resurgent Capital Services between July 2013 and September 2014. Consumers complained of:

  • Continued attempts to collect debt not owed
  • False statements or representations
  • Taking or threatening legal action
  • Improper contacting or sharing information with third parties
  • Continuing to call after a written request to cease contact.
  • Refusing to provide information to allow verification of the debt.

The Better Business Bureau said in September 2014 that it had closed 3,076 complaints about Resurgent Capital Services in the previous three years, including 1,255 in the prior 12 months. These included:

  • Billing / collection issues
  • Problems with product / services
  • Guarantee / warranty issues
  • Advertising / sales issues.

The BBB lists a complaint as “closed” when it is satisfied with the company’s response. “Closed” does not indicate that the consumer is satisfied.

In May 2014, the State of New York announced a settlement that required Sherman Financial Group to pay $175,000 to the state as civil penalties and costs for repeatedly bringing improper debt collection actions against New York consumers.

In July 2012, the Maryland State Collection Agency Licensing Board reached an agreement with Resurgent Capital Services and LVNV Funding LLC, another subsidiary of the Sherman Financial Group, that resulted in the companies dismissing 3,500 lawsuits for more than $7.7 million against consumers pending in Maryland district courts. The agreement also required the companies to apply credits totaling over $3.8 million to the accounts of over 6,200 consumers whose cases have already been adjudicated or settled, and to pay a penalty of $1 million to the state.
